The agreement for using BodyCast.
BodyCast gives you friendly, general-wellness suggestions based on the weather. These terms explain what that is — and, importantly, what it isn't. By using the BodyCast app or this website, you agree to them.
BodyCast ("BodyCast", "we", "us", "our") is provided by The Yellow Labs. If you do not agree to these terms, please do not use BodyCast.
1. What BodyCast is — suggestions, not advice
BodyCast turns public weather and air-quality data into a daily, general-wellness heads-up about conditions that some people find affect how they feel. Everything BodyCast shows is informational and a suggestion only. It is general in nature, is not tailored medical guidance, and is not an instruction to do or not do anything.
2. Not medical advice; not a medical device
BodyCast is not a medical device and does not diagnose, treat, cure, prevent or monitor any disease or condition. It is not a substitute for professional medical advice, diagnosis or treatment. Never disregard or delay seeking professional advice because of something you read in BodyCast. Always consult a qualified healthcare provider about your health and before making any health-related decision. If you think you may have a medical emergency, contact your doctor or emergency services immediately.
3. Where our information comes from, and its accuracy
BodyCast derives its risk levels and guidance from publicly available standards and research — including those published by bodies such as the World Health Organization (WHO), the U.S. Environmental Protection Agency (EPA) and the World Meteorological Organization (WMO) — applied to third-party weather and air-quality data (currently provided by Open-Meteo, drawing on national weather services such as ECMWF). We do not create or control this underlying data and standards, and we do not warrant that they, or our interpretation of them, are accurate, complete, current, or suitable for your situation. Forecasts are inherently uncertain and may be wrong.
4. Provided "as is", without warranties
BodyCast is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, to the maximum extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that BodyCast will be uninterrupted, error-free, or that any notification will be delivered.
5. Your responsibility & assumption of risk
You are solely responsible for any decisions you make and any actions you take based on BodyCast. You use BodyCast at your own risk. You should use your own judgement and consult appropriate professionals for any decision that could affect your health or safety.
6. Limitation of liability
To the maximum extent permitted by law, in no event will The Yellow Labs, or its founders, employees or partners, be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of health, profits, data, or goodwill, arising out of or relating to your use of (or inability to use) BodyCast — even if advised of the possibility. To the maximum extent permitted by law, our total liability for any claim relating to BodyCast will not exceed the greater of the amount you paid us for BodyCast in the 12 months before the claim, or USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; nothing in these terms excludes liability that cannot be excluded by law.
7. Indemnification
You agree to indemnify and hold harmless The Yellow Labs from any claims, losses or expenses arising out of your misuse of BodyCast or your violation of these terms, to the extent permitted by law.
8. Acceptable use
Use BodyCast only for lawful, personal, non-commercial purposes. Do not attempt to disrupt, reverse-engineer, overload, or misuse the app, our servers, or the third-party services we rely on.
9. Third-party services
BodyCast relies on third-party services (such as Open-Meteo for weather data and, for the optional AI feature, Anthropic). Their data and services are governed by their own terms, and we are not responsible for them. See our Privacy Policy for how data is handled.
10. Changes
We may update, change or discontinue BodyCast or these terms at any time. If we make material changes to these terms, we'll update this page and the "last updated" date below. Continuing to use BodyCast after changes means you accept them.
11. Governing law
These terms are governed by the laws of India, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of its courts — except where mandatory local consumer-protection law gives you other rights. (The Yellow Labs: confirm your registered entity and the governing-law jurisdiction with a lawyer before launch.)
12. Apple App Store
If you obtained BodyCast through the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies, and these terms are between you and The Yellow Labs (not Apple). Apple is not responsible for BodyCast or its content, and is a third-party beneficiary entitled to enforce these terms.
